TechnoKids Philippines Curriculum License Agreement
These Terms of Service apply when you use a TechnoKids Curriculum, website, mobile application, or other online service in various platforms that links or refers to the Terms.
1. General
1.1. TechnoKids Philippines may change the Terms or modify any features of the Services at any time at our sole
discretion.
1.2. The Licensee acknowledges the Curriculum is licensed, not sold, to the Licensee for use only under the terms
and conditions of this license.
1.3. These terms are a legal contract between the Licensee and TechnoKids Philippines so it is important that the Licensee review them carefully before using the Services. The use of the Services indicates that the Licensee agrees
to follow and be bound by the Terms, which include the Discussion and Submission Guidelines.
1.4. If the Licensee does not agree to the Terms of this license, Licensee must not install, download, access, or use
the Curriculum or the Services.
2. Definitions
2.1. The Licensee is the individual, school, institution or organization licensing the Curriculum.
2.2. The Curriculum or Services is collectively, all versions and format of the projects (including, but not limited to
TechnoKids Curriculum contents and resource files, teacher guides, students workbooks, brochures, modules, text,
photographs, graphics, videos, audio content, computer or software codes and other publications or documents
prepared by or on behalf of TechnoKids Philippines.
3. Authorized Users
4. Terms of Use
4.1. Usernames and/or passwords issued by TechnoKids Philippines to the Licensee in order to access the Curriculum must be kept confidential.
4.2. Licensee has the right to transfer the teacher guides, student workbooks, and or other documents that are part of the Curriculum to an unlimited number of devices at the Site for use by Authorized Users.
4.3. Licensee has the right to place the Curriculum onto a memory device, local computer, LAN server, or cloud-based server for the purpose of distributing files for use by Authorized Users. Posting files in the public domain on the Internet is prohibited.
4.4. Authorized Users may also use the Curriculum on Licensee's desktop and portable devices which are away from Licensee's facilities provided that it is for the purpose of using the Curriculum by the respective partners.
4.5. Resource files including parent letters, certificates, templates, samples, and assessment tools that are part of the Curriculum, may be customized for the purpose of meeting the Site’s objectives, on the understanding that copyright information is clearly displayed within all files and the copyright remains with TechnoKids Philippines.
4.6. Workbook resource files that are part of the Curriculum may be annotated using a PDF reader for the purpose of completion and or submission.
5. Ownership
The Licensee acknowledges that TechnoKids Philippines is the sole owner of the Curriculum. TechnoKids Philippines reserves any rights not expressly granted to Licensee. The rights granted are limited to TechnoKids Philippines’ intellectual property rights in the Curriculum and do not include any other patents or intellectual property rights. The Services may contain third-party owned content and links to other websites remain property of the respective owners. TechnoKids Philippines does not endorse, sponsor, recommend, or otherwise accept responsibility for any Third-party applications and websites used in its contents. In addition, Third-party applications and websites are not under the control of The TechnoKids Philippines and its respective partners, and The TechnoKids Philippines is not responsible for the content or privacy practices of the Third-party applications or websites.6. Prohibited Conduct
6.1. The Licensee may not sell, lend, lease, rent, assign, or transfer the Curriculum to another party in any form.
6.2. The Licensee may not translate, reverse engineer, de-compile, disassemble, or create derivative works based upon the Curriculum or any part thereof.
6.3. The Licensee may not circumvent security features that protect the copyright holder, TechnoKids Philippines
6.4. The Licensee may not use or export the Curriculum to another country.
6.5. The Licensee is strictly forbidden from posting the Curriculum in any format which makes it accessible to non-authorized users.
6.6. The Licensee may not access or use, or attempt to access or use, the Services to take any action that could harm us or any third party, interfere with the operation of the Services, or use the Services in a manner that violates any laws. For example, and without limitation, you may not:
6.7. Make use of the contents of the Services in any manner that constitutes an infringement of our rights or the rights of other users or third parties, including copyrights.
6.8. Access parts of the Services to which you are not authorized, or attempt to circumvent any restrictions imposed on your use or access of the Services.
6.9. Copy, reproduce, distribute, publish, enter into a database, display, perform, modify, create derivative works, transmit, or in any way exploit any part of the Services, except for content you have posted on the Services, or unless expressly authorized. You may download material from the Services solely for your own personal use as follows: you may make one machine readable copy and/or one print copy that is limited to resource files of personal interest only.
6.10. Engage in unauthorized “scraping” or spidering, or harvesting of personal information, or use any unauthorized automated means to compile information on TechnoKids Services.
6.11. Use or attempt to use any engine, software, tool, agent, or other device or mechanism (including, without limitation, browsers, spiders, robots, avatars, or intelligent agents) to navigate or search the Services other than the search engine and search agents available on the Services and other than generally available third-party web browsers.
6.12. Attempt to decipher, decompile, disassemble, or reverse-engineer any of the software comprising or in any way making up a part of the Services
6.13. Engage in any other conduct that restricts or inhibits any other person from using or enjoying the Services.
6.14. Take any action that violates or threatens our system or network security.
7. Termination
7.1. Violations of these Terms may result in civil or criminal liability. TechnoKids Philippines may investigate violations of these Terms and we may also work with law enforcement authorities to prosecute users who violate the Terms.
7.2. TechnoKids Philippines reserves the right, in its sole discretion, to restrict, suspend, or terminate the access of Licensee to and use of the Service, with or without prior notice once proved or caught with the violation.
